This is a book on a very important branch of civil law, the Law of Trusts. The Law of Trusts deals with both private and public trusts.
In the field of private trusts, the book considers the provisions of the Indian Trusts Act, 1882, and decisions of Indian and English Courts on the subject. An important, and ever-growing branch of private trusts is Constructive Trusts, growing as Courts impute fiduciary duties to all situations where a person obtains an unfair advantage over another. This aspect is considered at length.
Public Trusts are mainly charities and the book considers the statutes and decisions on all aspects of the principles of the Law of Charities as well as relevant Indian and English decisions. The provisions of State Acts relating to the registration and other formalities which have to be complied with in the case of most public charitable trusts are not, however, discussed.
