The key factor in the whole discourse in the present work is ‘gender’. The book endeavors to create, develop and spread gender consciousness among the people at large. Arguably the issue of the Uniform Civil Code (UCC) is viewed in the book through the lens of Gender.
To begin with, the book examines women’s rights and their socio-economic status and role across the ages in India, particularly when the formation of gender role began and how every thing was appropriated by patriarchy, feudalism and casteism in course of time. Later, it discusses the origin of Hindu law and legal reforms there. It is also examined here how the UCC has been communalized and politicized and what has been the role of ‘Hindutva ideology’ in the process. The role of Women’s movement has also been highlighted in the debate and discourses of UCC in favoring it as ‘Gender Just Code.’
This book seeks to offer is a comphrensive treatment of the evolution of Islamic law, its formulation, and reformulation in the course of time, its interpretation and implementation by different schools of thought and followers of different sects among the Muslims. It also gives an account of reforms, and changes brought out through Shariah to safeguard the women’s rights. Infact, this work helps develop an insight into the fact that true Islamic law gives maximum rights to women, which are denied to them in practice and tells what actually Muslim law is? Moreover, it analyses international developments and reforms in Muslim personal laws and discusses what steps should be taken towards legal reforms in Muslim personal law in India.
